Privacy Statement

When you apply for a loan or an investment, we collect personal information from you, including (but not limited to) information about your name, address, email, phone number, date of birth, IRD number, credit card details, financial information, bank account details, gender and nominated beneficiaries.

We collect your personal information for the purpose of assessing your application for finance or for investment in CFML managed funds, as per your application.

CFML is required to collect certain personal information in order to comply with its legal obligations, including (but not limited to) the following legislation:

1. Companies Act 1993;
2. Financial Markets Conduct Act 2013 (FMCA) and Financial Markets Conduct Regulations 2014;
3. Credit Contract and Consumer Finance Act (CCCFA) 2003;
4. Income Tax Act 2007;
5. Tax Administration Act 1994;
6. Anti-Money Laundering and Countering the Financing of Terrorism Act (AML/CFT) 2009 and Anti-Money Laundering and Countering the Financing of Terrorism Regulations 2011; and
7. Any regulation or legislation enacted or issued in addition, amendment or substitution to any of the above.

We may share your personal information with CFML’s related companies, agents and contractors that provide services to CFML or perform functions on our behalf, including its supervisor, custodian, trustee, auditor, compliance consultant, funders, AML/CFT auditor, rating agencies and electronic verification providers in order to determine if you meet our criteria for providing finance and/or investing in CFML managed funds to meet our legal requirements as mortgage lender and fund manager.

At no point will your details be passed onto any third party unless you have provided express written permission for this to occur.

CFML uses such security safeguards as reasonable in the circumstances to protect information from misuse, interference and loss, and from unauthorised access, modification or disclosure. 

Providing information is optional. If you choose not to provide your personal information, we’ll be unable to provide our products and services.

If your entity is a trust, then you confirm that as an authorised representative of that trust, you have notified all individuals listed in your Trust Deed that their information will be collected by CFML, held, used and shared as set out in this privacy statement.

You (and all other individuals you have shared about) have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. How your information is used:

Information Logistics Company Limited (Infolog)

We may provide your personal information to Information Logistics Company Limited when we use their identification verification services to meet our AML/CFT obligations.

Centrix Group Limited (Centrix)

We may provide your personal information to Centrix Group Limited when we use their consumer credit reporting services (eg for credit checking).

Centrix will collect your credit information for the purpose of providing credit reporting services to us and other subscribers to Centrix consumer credit reporting services, and Centrix will use and disclosure your credit information in accordance with the Centrix Privacy Statement.  You have rights of access to, and correction of your credit information and any other personal information held by Centrix as set out in Centrix Privacy Statement.

London Stock Exchange Group (LSEG)

We may provide your personal details to LSEG to perform ongoing checks to meet our AML/CFT obligations.   (eg politically exposed persons lists)

Equifax Pty Ltd (Equifax)

If you default in your payment obligations to CFML, information about that default may be given to Equifax, a credit reporting agency and Equifax may give information about your default to other Equifax customers.
